Subject: Reconsider Gazette Prohibiting Cannabis Sativa L. Foodstuffs, Including Hemp and Edible THC

Dear Dr. Motsoaledi,

We, the undersigned, urge you to reconsider the recent gazette banning the sale, importation, and manufacture of foodstuffs containing Cannabis Sativa L., including hemp, hemp seed oil, and hemp seed flour. This conflicts with South Africa’s progressive cannabis laws legalizing smokable THC and supporting an edible THC industry built on recent reforms.

The prohibition threatens jobs, investment, and growth in a sustainable sector, while restricting access to nutritious, non-psychoactive hemp products recognized globally as safe. Edible THC should remain legal, and hemp derivatives should be exempted from this ban.

We Request:

  1. Amend the gazette to permit hemp-derived foodstuffs and uphold edible THC legality.
  2. Protect the existing cannabis industry.
  3. Consult stakeholders for balanced regulations distinguishing psychoactive and non-psychoactive products.

South Africa’s cannabis progress must not be undone. We seek your support to align this policy with economic, health, and legal realities.
